If you are referring to an unsecured personal loan the lender could make a valid claim that this debt is nondischargeable i.e. the bankruptcy would not terminate this debt. Please contact me if you have any further questions how to best handle your situation

Do not take the loan to pay for the attorney. This will not be looked at kindly by the trustee. The trustee may look back as much as a year sometimes more, to determine if you were making any purchases with the intent to default on the debt by filing bankruptcy or involving yoursel in fraudulent transfers. Also $5,000 is a very steep fee for an attorny to file a chapter seven bankruptcy. Your purchases will be looked at as fraud. Do not make them before filing bankruptcy or you may open yourself up to criminal liability. Feel free to contact us for a free consultation. 203.521.4915.
