If I am listed as a debtor, what are my rights?

Hello,

I was listed by my ex as a debtor. I was not notified until it had already went to court so I was not able to disagree or anything. He owes for many different reasons such as child support and rent when he lived with me. He actually borrowed more money from me before I received the letter knowing he would not have to pay it back. I presume that you were listed as a creditor in your ex-husband's bankruptcy. Under the Bankruptcy Code you have the right (without asking the Bankruptcy Court for approval) to enfore either alimony or support. But you may have missed the time to recover any money for any form of property settlement. The time limit is generally approximately 2 months after the first meeting of creditors. You should have received a notice of his bankruptcy, if you never received a notice, you may still have time to object. However, if you are seeking recovery of money that he borrowed from you, you are a general unsecured creditor. If he has listed all of his assets, you may not be entitled to any recovery because of the Bankruptcy Code. To give you a more complete answer, you need to provide more facts.
