New Business...Is this legal?

I am starting a business selling photographs of scenic views and historical sights in my town and surrounding areas. If I was to take a photograph of someones property (house, car, etc) would I have to get their permission to sell it or not?

The issue is whether the subject matter is in plain view. You don't want to find yourself in a situation where you might "invade someone's privacy." Although it is difficult to win a suit in which someone claims you invaded their privacy, it is a viable cause of action depending on the circumstances.

If you are taking pictures from the road or a public place you should have no problem. As long as you do not take extraordinary steps to "take the picture," (i.e. climbing 10 foot hedges and peeking over the top into someone's court yard, or through someone's windows) you will not be in a situation that could give rise to a lawsuit.
