contract violation

We are a vendor of a large

supermarket chain. The retailer

solicited us looking for us to give

them discounts so that they could

lower retail pricing and become what

is called an EDLP retailer. We gave

them generous discounts and they

took them but then kept the retail

prices the same. The only thing that

happened is the retailer increased

their own profit margin.

Hello. It sounds like you are trying to identify your legal rights with regards to this retailer. In order to do so, it is best to start with an examination of the following:

1. Do you have any written contracts with the retailer?

a. Do they spell out the terms of the negotiated lower pricing?

2. What is your goal - to change the pricing back to the regular pricing, or to be compensated for damages caused by their not honoring your agreement?
