Money lost as a result of payroll company error
I use a payroll company for my business. 6 weeks ago they accidently sent a terminated employee nearly $1000 by direct deposit. I reported the error to them immediately and they said they would take care of it. A week later the funds were still not back in my account and when I asked, they said that they couldn't get the money back if it had been more than 5 business days since the transfer (I notified them on the 2nd business day) and that I had to get the money back from the former employee myself. I have been unsuccessful at getting the money back from her and the payroll company won't credit me the money even though this was their error and I did everything I was supposed to in a timely fashion. What are my legal options? Do I go after the employee or the paycheck company?

I'm curious as to what the contract says between you and the payroll company.
I hope you have proof that you contacted them on the 2nd day.
I would think that you could seek relief from the payroll company but I would need more information.
