Replaceing Bakery Equipment

We own a bakery that was built in 1963, recently we bought a new deep fryer to replace our old one, which is sitting in storage right now and the old one is still in place, when the fire marshall came around he informed us that we will have to bring the venthood up to current code when we put the new deep fryer in which is very expensive, Do we have to bring it up to code if we are simply replaceing our old deep fryer with a new on which is an exact same model as the old one?

Generally, if the fire marshall says that the venthood needs to be replaced, then you should replace it. But if you think it isn't fair or that he isn't correct, then you can complain about his actions.

In order to determine whether you needed to replace the venthood, I would have to look up the local code.
