Legal Question in Business Law in Connecticut

Sale of Trailer

I was given a deposit for the purchase of a trailer and a cash receipt/agreement was signed. I decided that I do not want to sell. What do I need to do in order to break this contract.

Re: Sale of Trailer

If the buyer is willing to release you from the contract you will need to have them sign a release when you return the deposit. If your position is that you did not have a binding contract with the buyer (you should have an attorney review the receipt/agreement to determine if you have a binding contract) then you should ask for a release any way when you send back the deposit. In the alternative you could send a check with a notation that by endorsing the check the buyer is releasing you from your agreement to sell but this language should be drafted by an attorney. If you need help in this regard please email our office and we will be happy to assist you. Jonathan Hoyt
