Legal Question in Construction Law in Connecticut

Hello,

We are homeowners who purchased a house in 1999 that was built in 1996. (It was 3 years old)

It has a center chimney with 3 fireplaces, one oil-fired boiler and a wood/coal burning boiler.

Last year we contacted a chimney company to clean the chimney due to deterioration of the wood/coal 'stove pipe' which was falling in. The chimney cleaners said the chimney has never been up to current building codes. My question is who is liable for such a faulty inspection and the high cost (up to $24,000) of bringing the chimney up to code. One chimney company said that it bordered on criminal.
