Legal Question in Consumer Law in Connecticut

Gasoline Spill

I went to a local service station to fill my car with gasoline. I started pumping, engaged the trigger lock and returned to my vehicle. After a little while I started to smell gas and stepped out of my vehicle to see that gasoline was spilling out of the tank and onto the ground. When I went inside to pay I was told that I was responsible for all of the gas that was pumped. I refused to pay any more than my tank could physically hold, as I believe this to be a malfunction of the pump itself. Who is right here?

Re: Gasoline Spill

I do not know much about gas pumps, however, it is my understanding that the pump stops pumping when the gas tank is full. If it malfunctioned, which sounds like the case, then I do not believe you are responsible for any more than the tank holds.
