private sale

I answered an craiglist ad for 2 pieces of exercise equipment on the day after it was posted. I went to look at the pieces that night and left a $40. deposit for $80. worth of equipment. I called him 15 min. later and said I had changed my mind. He feels he is entitled to 1/2 the deposit for his inconvienence? Is that legal?

I'm curious as to what the ad said. If it didn't mention the deposit and that you would lose a part of it if you changed your mind, then I don't think he's entitled to keep it.

You could sue him in small claims court. It costs $35.00, but if you win you are awarded the monies he kept plus the $35.00.
