Collection Agency

My mother received a phone bill for $2,800. There were a bunch of international calls on there that she didn't make. She has been fighting with the phone company but they have turned it over to a collection agency. My mother is 70. The collection agency contacted her by phone on June 19 and said she owes $3,800. They had her in tears. She gave them her bank info and they were scheduled to withdraw money out of her account on June 25. I had her send them a debt validation letter and telling them not to withdraw money out of her account until the debt was validated. It was sent certified next day. They signed for the letter on June 23. She went to her bank on June 23 and told them not to let the money be withdrawn. They told her they wouldn't let any money be taken out. Well, on June 27 the bank did let the collection agency withdraw money out of her account. What can be done? They were notified in writing by certified mail not to do anything until the debt was validated. What rights does she have?

She could have a conversion action against the bank but to verify this, she really should speak to an attorney right away. Do not delay -- delay could jeopardize her rights.
