Legal Question in Credit and Debt Law in Connecticut

Non court issued wage withholding

A wage garnishment order was received by my employer. It is issued from a collection agency not a court. It is for approximastely $13,000.00 for a student loan. I am a single mother and they 10% they are requesting would mean an extreme hardship on me. Does my employer have to garnish my wages if it is not court ordered or is this a type of scare tactic from the collection agency?

Re: Non court issued wage withholding

From your post, it certainly sounds as if there is either some misunderstanding or the collection agency is acting illegally. Your employer should have the "wage withholding" reviewed by an attorney. In Missouri, the creditor would need a Court Judgment against you before a garnishment would be issued. If the collection agency is acting illegally, you should file suit against the collection agency.
