Repo item without proper notification

I signed a contract to purchase a snowmobile for a friend. This friend was supposed to make all of the payments. As you can guess, the friend stopped paying after approximately 1 year. The friendship kind of dissolved before that year was up. Without any knowledge on my part, the snowmobile was reposessed. The finanacial institution made no attempt to contact me, except for one call demending money (a sibling of the friend agreed to resume making the payments). I haven't heard anything about this for at least two years when all of a sudden a couple of weeks ago I got a call from a collection agency demanding money. The financial company says they contacted me, which is flase, and also won't give out the call log or the original contract (the friend took and lost my copy). I am not sure what my options are in terms of: paying the debt (I feel contact should have been made if their was a repo); the financial company (chnaging parameters of my signed loan with payor and not informing me); and friend (is there any culpability on their part)?

If you were never properly notified you may have a case for wrongful repossession. However the facts are a little unclear. The collection agency may be violating the Fair Debt Collection practices act. You should keep track of when and what dates they contact you as well as what they say. Any letters would also be helpful. Our firm reviews such information as courtesy and sues debt collectors for violations.
