Get rid of the ex

5 yrs ago when I was with my exbf, I obtained a home equity loan with both our names on it, through my house that I solely own. We are no longer together. He has been making the payments and is never late. However I want to eventually refinance or sell my home and I can't with his loan attacked. Plus I just want to really cut ties with this person. Since he has followed our written agreement and is making all payments, can I take him to small claims court and request he get a loan in his own name to pay this one on my house off? I don't like being trapped in this situation and not able to refinance or sell my house. Thank you for any advice!
