Legal Question in Criminal Law in Connecticut
If I catch my husband having an intimate/sexual relationship with my 16 y/o daughter and I audio record some proof, can it be used in a criminal case/ is it legal?
1 Answer from Attorneys
Under Connecticut law, statutory rape is the commonly used name for the criminal offense that occurs when a person has sexual relations with another person who is not old enough to legally consent to having sexual relations. Even if the victim or the victims parents refuse to cooperate, the States Attorney can still file criminal charges against the other person. Also, the victims parents may file charges even if the victim does not want to file charges. If you are suspicious of this you should not be taking the time to audio record proof, but rather should be removing your daughter from the situation and filing criminal charges against your husband.
