How can the same act be the basis for civil and criminal liability?

There are two standards: The highest is for criminal, which is beyond a reasonable doubt, and a lesser for civil is prepondance of the evidence, which means more than 50% in favor of the winner in a civil action. Someone could be found no guilty in a criminal action, but could be found liable in a civil action. Tom Noonan
