What do I have to do to get a felony expunged from my record?

In order to have a charge expunged from your criminal record, the charge must have been disposed of with a dismissal or a nolle pros. You may also expunge charges to which you received an acquittal. There are other restrictions on expungment, such as a dismissal of domestic violence charges under 18.2-57.3. Convictions are not eligible for expungement. If you are eligible, file a petition with the court and fulfill other requirements articulated in the Virginia Code. There is no guarantee, even when the charges were dismissed, you were not found guilty, or the Commonwealth opted to not prosecute you, that your expungement request will be granted by the court.
