Legal Question in Criminal Law in Connecticut
minor arrested for buying alcohol & showing fake id
Police staked out a liquor store, but didn't approach an exiting 17-yr-old male until he was around the block down a street and in his car. Then they asked what was in his trunk. Police said they stopped him because they thought he was on his cell phone (wasn't). First time he was stopped, frightened that a car was following him (unmarked) and answered everything honestly...like, have you used a fake id before (yes.) Why wouldn't they stop him right outside the store? Did police act appropriately? Think we should have an attorney? Or just take whatever punishment judge gives w/o trying to reduce it?

He was stopped on the pretext that he was on his cellphone in order to support the officer's guess that he committed a crime. You should hire an attorney to further look into the legality of the stop. If the stop is illegal the case may be dismssible or any evidence seized may be suppressed. Dennis P. McDonough
