Legal Question in Criminal Law in Connecticut

Nephew

Hello,

My nephew is 17 years old and is currently being charged with three felony charges. Our law has advised us of his option, which in many cases don't seem to be working in his best interest. Before returning back to court for his last hearing, he was placed on house arrest and served 5months on house arrest. His options are as followed.

1.plead guilty to the three felonies, serve two years of probation and the felonies remain on his record for life

2.Serve a year in prison and have the charges drop to a misdemeanor

Is it possible to have charges drop to misdemeanor after serving time? What other option do we have, if our often to place my nephew in an alternative program is turn down?

How can we convince our lawyer to push to use the house arrest as time served? What are our legal rights as a family?

Generally, you can not convince yoru lawyer to realistically do anything - however a case is 'your' case and the decisions should always be left up to the client.

I am with a criminal firm and I will tell you that our normal policy is to fight for absolutely everythign to count as time served, and to not plead till there is no further option.

Has motion schedule been set on this case? If so what was the result? Such motions would potentially buy time for the client to get a better offer, and generally this tactic works. Furthermore, if through motions some or most of the evidence can be supressed then this would withotu question help your case in the long run and subsequently any potential offers.
