Legal Question in Criminal Law in Connecticut

Parental Kidnapping

I came home one night and the house was empty. My wife took our child out of the state. I don't know where she is and have had no contact. Is this a criminal offense in CT. There is no history of any abuse. She told her parent she just wanted a change because she was unhappy. And was angry with me for moving to CT. And blames me for the marriage not working. We are not divorced but I am going to file. The child is 2 years old and cannot understand or be forced.

I just want to know did she commit a crime? There are no underlying issues.

Re: Parental Kidnapping

The parent does have a right to take the child where they want. However, to accuse her of kidnapping is a serious criminal offense. If you have doubts about the safety of the child, or think the child may be in harm, then you should contact the appropriate authorities. Without such doubt for her safety, you should attempt to contact her and your spouse. If you are going to file for divorce then you should, in order to get the proceedings underway. The court will then be in a better position to monitor the actions of you, your spouse and the child.
