Legal Question in Criminal Law in Connecticut

possession of marijuana and intent to sell

My nineteen-year old son was arrested for possession and intent to sell. The local cops put him in touch with a narcotics task force, and said if he helped try to set up his supplier, they'd put in a good word for him and maybe get the felony charge dropped. He went to court, met with someone, and they suggested a drug awareness class and maybe community service. He went back today, with the money for the class, and the same prosecutor told the judge not to accept the deal. They now told him he needs to talk to a lawyer. Any suggestions?

Each criminal case is vastly different. Without being part of the process and involved in the file, it is impossible to offer an opinion on why the State (prosecutor) would change an agreed upon disposition that was discussed with your son.

A consultation with an attorney, or hiring an experienced criminal defense attorney, may be of benefit to his situation.

Re: possession of marijuana and intent to sell

You and your son should definitely speak to a lawyer. That your son was advised to apply for community service suggests to me that he does not have a record and so as a first time offender may be eligible for a program that keeps his record clean. Avoiding a criminal record is extremely important for someone just starting out, especially if drugs are involved. I could only provide specific advise by getting additional information, particularly in regard to what evidence there may be that would show intent to sell rather than just mere possession. Please call my office if you would like to discuss this further (860.977.0660 or 860.236.9350).

YES! HIRE A LAWYER IMMEDIATELY! you should have never allowed your son to communicate with the police without an attorney presetn, the policeh ave no power to dictate what the Distrcit Attorney will do as far as regarding an offer on any case...
