Legal Question in Criminal Law in Connecticut

Prior Record + Traffic Stop + Search

As a 17 yo juvenile my son was convicted of a felony for shooting a bb gun & a window breaking (shooting a weapon). He was given probation, comm. service, drug testing, etc. He completed that. In Florida.

Just after he completed that we moved to ny on Ct border. One night he was pulled over for speeding. After checking his license, which was fine, the officer came back to car and told him he saw he had record in Fl. for shooting a weapon and to get out of car. They never asked to search car, although did ask if he had weapons. At first he said no, than remembered he did have brass knuckles in console, and thought that may be considered weapon. They proceeded to search, he still was not asked if they could. They handcuffed him, and searched veh. got brass knuckles and also found a pot pipe, unfortunately.

My main question is does his prior juvenile record give them reasonable cause to detain him longer, and than search auto??? Also, will his juvenile record from Florida become auto sealed due to his age at the time.

Thanks for any info.

Re: Prior Record + Traffic Stop + Search

The prior record cannot support probable cause to arrest or search the vehicle. The prior record should be sealed. If you need further help, you can email me at [email protected].
