Legal Question in Criminal Law in Connecticut

Son charged with Sale of Marijuana

A officer showed at my home.Said he had a warrant for the arrest of my son.I asked to see it and he said it was at the station.Said it was for sale of marijuana & conspiracy at the sale of marijuana.Took my son in cuffs. He was held on a 25,000 bond.I bonded him out.How can they arrest my son on these charges if they didn't catch him with the weed. The detective said that he watched my son and another kid sell it to someone about three months ago.I don't know what evidence they have but can they just accuse him of this charge on hearsay? They said that I could not see the evidence that I would have to have an attorney supeana it.I don't understand if the detective saw my son in a drug transaction why he did not grab him and arrest him then. How much evidence do the police need to have before a judge will sign a warrant and why did they not have a search warrant to be able to search the property if they suspected my son was dealer. Also they did not read my son his rights,he did sign some paper work at the station do they have you sign something saying that your rights were read to you?My son is only 17 and did not read the paperwork although he doesn't remember signing anything about his rights being read.Any help would be appreciated!

Re: Son charged with Sale of Marijuana

Your son is charged with fairly serious charges. Without seeing the documents it is diffucult to give an exact opinion. However, in order to obtain a warrant, the officer had to show probable cause. Second, because your son was arrested he was entitled to his rights being read to him. If he signed a waiver, there may be issues with that waiver as he is a juvenile and not an adult. Again, without seeing the documents myself it is difficult to advise you and your son. These are only general suggestions. If you need further help, feel free to contact me at [email protected].
