CT Underage Drunk Driving

Scenario: 18 year old male totals car into tree at high speed-minor injuries. Not tested by cop at scene of crime, 30-45 min later at hospital, nurse gives breathalyzer-1.2 which is .04 over the limit. What legal action results for the male?

What happens depends if the 18 year old is charged with anything. If a search warrant is obtained for the blood trst results taken at the hospital, the 18 year old can expect an arrest for DWI and a suspension of his operating priveledges. You dont say if there was a 2nd car involved and who was injured (driver or passenger). Civil lawsuits can be expected if more than a 1 car 1 driver accident
