Fatal motor vehicle accident

My sister was killed in an accident that invoved both drugs and alcohol. Since the vehicle she was in cartwheeled 3-5 times, the police could not determine who was driving. Her death certificate listed her as the passenger of the car. It has been a year since the crash and the investigation is still open, when I have questioned the trooper about the case he seems bothered and claims he is closing the case as her being the driver. What can I do? The other person in the car at the time had his license under suspension at the time for DUI, and was known to drive her car to not be seen driving under suspension. He survived the accident with some bruising and a broken nose, she was thrown from the vehicle through the passenger side window. The investigating trooper has stated he does not want to issue a warrent for a ''bad arrest''.

If the state is not willing to pursue criminal charges, you still have rights in the civil court. Depending on other factors, you can sue the driver for a host of reasons and claims.
