Is there more of a penalty for a parent if she drives while intoxicated or if her 15 year old son without a permit drives her home?

Yes. There are penailties for both that can be quite severe, including possilbe incarceration for the parent and the possilbilty of DCF invovlement. If you plan on drinking, drink at home, not to the level of intoxication. If you need to go out, find a designated legal non-drinking driver or take a cab. You would be much better off this way.
