abandonment
my husband left our home willingly
(no court order) after he was issued
a disorderly ticket after a domestic
issue in our home. he refusees to
come home and we have 2 children
ages 6 months and 2 years. he has
been gone almost 6 months now. if
we were to get a divorce, is there an
abandonment clause?

While not the only means, it may serve as a grounds for a divorce. In addition, it will be relevant in determining custody and child support. The court will take into consideration the fact that he abandoned the welfare of his family for a certain amount of time. If you need further help, you can email me at [email protected].

Abandonment is a grounds for divorce but it would be much simpler for you to say that your marriage has broken down and there is no reasonable chance of getting back together as husband and wife. The legal term for this is "irretrievable breakdown."
I am guessing your real concern may be whether a divorce court will hold it against your husband that he abandoned you and your young children. The answer is yes. He should be paying child support and perhaps alimony as well. If you cannot afford an attorney, the divorce court may order that your husband pay your attorneys fees. You can also contact the Connecticut Bureau of Support to get child support from your huband.
