alimony

My husbands lawyer is trying to bar me from alimony because i moved in with my boyfriend a few months after i filed for divorce.My husband and i were living in our house together but both had significant others.He was constantly bullying me to move out so moved in with my boyfriend.I stayed only 23 days because i found out he was an alcoholic and very verbally abusive.They are trying to bar me from alimony now since i lived with him for 23 days.Can they do this? I left him because of the drinking and abuse,it wasnt a safe home for my daughter and my husband knew this.I was upfront with him when i left my boyfriend,and told him what happened.Now hes turning it around to look like i left him because i knew if i lived with him i wouldnt get alimony,even though he knew the truth but is lying now to the court about the reason i left.Is there a time period i had to live with my boyfriend to not qualify for alimony? do i have to now prove why i left him after living there for 23 days?MY ex boyfriend is willing to testify for me that he has anger issues and a drinking problem that led to me leave him after living there for 23 days..Can my husband and his lawyer use this to bar me from alimony? I was married 8 years and was a housewife.

What is your lawyer's response? The basis for alimony is in the statutes. Cohabiting is usually a reason to terminate the alimony after the dissolution. You are focusing on the wrong issues. Stick with the statute- Your attorney needs to argue for you.
