Legal Question in Family Law in Connecticut
Alimony Modification after unemployment
I will be 62 in April, I have been unemployed for 7 mo. I have been paying alimony with no payments missed for almost 4 yrs and owe 5 plus more years more. I have no income and will have to take a job at less than half of what I was earning at time of divorce. My X recieved 2/3 of the assets plus was awarded 900.00 mo In order to pay the same amount I will have to use savings giving no retirement option for atleast 6 more years. I don't believe this is fair in any regards, since she has several hundred thousand dollars of cash assets and investments plus owned and payed for realty when I am using my saving to pay weekly alimony. It gets better--beside the alimony she also has income for disability comming in ever month for over 700.00 what am I suppose to live on with no employment or best case income under 20,000 when I do find work.

Re: Alimony Modification after unemployment
It is unusual to have an alimony award that is non-modifiable. If, for some reason, yours is non-modifiable, you may not be jailed for contempt, just postponing the inevitable payment, but a judge could insist that you use up savings to meet your alimony obligation. I'd have to see the judgment, but if it is modifiable, you can file a motion to modify.
