Alimony payments

If a person was granted a $1.00 per year alimony payment and has not received it in over 10 years does it null the judgement for alimony or can one request the back payments? It is not the need for the $1.00 a year, but the possiblity that at some point in time, if the spouse receiving the alimony became disabled, that granting alimony at all allowed that spouse to petition the court for a larger amount.

In CT, in order to claim alimony, post judgement, such as a disability, a spouse must be awarded at least $1.00 per year. If it is not paid, that person can file a motion for contempt to collect the back amount. However, at a $1.00 a year, the cost to file the motion and the sheriffs fees would pay for the alimony for the lifetime of the person, plus it may trigger a motion by the other party to eliminate alimony or some other motion. The fact that it is not paid does not void the court's order to pay the alimony. Hope this helps. Tom Noonan
