automatic court order
My husband served me the divorce paper unexpectedly. I have been separated from him (no legal separation) for a year. I have put a deposit for buying a one bedroom to live in and have signed the contract. If I back off I will lose my $25,000 deposit. My feeling is as I have signed the contract I have to go ahead. Am I going to be incontempt of court?

The automatic orders prohibit you from "transferring" any property or incurring "unreasonable debts." Under your circumstances, I think you can go ahead with the purchase because the debt you are incurring (the mortgage on the 1 bedroom) is not unreasonable, particulary if you stand to lose your deposit if you do not go forward. Of course, the safest way to proceed would be to get a court order approving the purchase. Please call me if you would like to discuss this or any other aspect of your divorce further.
