Having a Baby

My partner and I want to have a baby but we aren't married. In our state, same sex marriage is legal but we do not plan on getting married. How can I be assured that if something were to happen to me, that she would not have to fight to maintain custody of the baby and legally, the state will see her as the other parent?

Your partner should legally adopt the baby. This would assure that she is the legal parent with all of the same rights as you would have as the biological parent. Her rights would exist no matter if something happened to you, or, you both separated and terminated your relationship.

Your child would also benefit from these rights. For example,your child would be able to inherit from her if something happened to her and she left no will, or, your child could be covered under her insurance.
