Legal Question in Family Law in Connecticut
Bankruptcy and past due child support
My ex owes a substantial amount (close to 6 figures)in past due child support payments. He declared bankruptcy in CT, and I received a notice that some money had been received by the court. I filled out the paper work for the debt due for child support, but so far, the only paper work I have received is for various claims against the money. Do I need a lawyer to petition the court on my behalf? I am in GA. I thought child support would take priority over other claims. What steps should I take to get some portion of the amount left?

You didn't say where the divorce was finalized. If it was in GA, you can file a contempt of court against him even though he lives in CT.
Re: Bankruptcy and past due child support
Child support is not dischargeable in Bankruptcy. He still owes you the money. You should call Georgia's child support enforcement unit and request them to assist you in collecting child support from him in CT. Most states have the Uniform Interstate Family Support Act which provides that states shall assist eachother in collecting unpaid child support. There also may be a GA website with more information. You can also call CT's child support enforcement division for assistance.
