Well that depends on a few factors.
Do you both own the home jointly? If so, you can't get him out. He either agrees to sell it, or you buy him out, or you file a partition action in Superior Court to "divide" the property and sell it or reach an agreement to buy out.
If you don't own the house together jointly, but you own it outright, then you have to file an eviction action in Housing court to get him out.
If he owns the house outright, you can't get him out. You have to move.
If you rent an apartment and you are both on the lease, you can't get him out unless the landlord agrees to let you both out of the lease. Then you can move out.
If you rent an apartment and you are the only one on the lease, you need to file an eviction action to get him out.
