My brother is in a coma who has legal authorization regarding his care
My brother is in a coma who would have legal authorization regarding his care, my mother or his adult child. We live in California and his is in the hospital in New Haven CT.

I am sorry to hear about your brother. Check with CT law, but it is normally next of kin. In this case, it would be his adult children first.

Under CT law, either you, his adult child or his mother or another interested person could make application to the New Haven Probate Court for Appointment of a Conservator of Person and Estate. I actually get appointed as such when a family member does not want to or can not be appointed as conservator. When appointed as a conservator, he/she is in charge of managing all of his affairs. Many times I have been appointed when a person is in a coma. Your mother or your nephew can make application. They can just go down to the probate court on 200 Orange Street and the clerk will assist her/him in filling out the application. A hearing will be held to determine if he needs one and if he is in a coma a conservator will be appointed. The court prefers a family member over a stranger.
