Cell Phone Question

My STBX left me in the beginning of June and left the state that I live in. He took our son's cell phone with him and I have left this phone on so the kids can call him. He has not paid anything towards this bill at all, and now from his extensive usage, he's run up a very large amount ($325).

Since I have filed for divorce and it is still in the middle, can I turn off this service? I am not able to continue paying for this as I am not receiving support from him. If I turn it off, am I responsible for providing him a prepaid phone to use? He is not working and hasn't since February of this year.

Under the facts presented, I see no legal reason why you should continue supplying a cell phone. If you are wondering if he is entitled to some form of spousal support, that is for him to seek--not you to offer. Likewise, while he is entitled to see/talk to his children, it is his responsibility to see that occurs. Your obligation would be to not prevent or discourage the actual contact.

Check the automatic orders and read them carefully. There are things you can and cannot do once you file for divorce. You may want to file a motion with the court asking the court to limit his use to communication with your kids.
