Chances of Sole Custody

I am a mother of two boys (6 and 3). I divorced from my husband 2 years ago . He had a history of gambling and drinking. A few DUIs. He also is on Prozac for ADD. The divorce was mutual, smooth, no problems. We agreed to joint custody at that time. In the two years following the divorce my ex husband has lost his job, is now currently homeless, hasn't paid child support in over 3 months and has also had a car accident (DUI). His homelessness and joblessness and other factors are severely influencing the boys. My ex doesnt feel there is anything wrong with his life but I am seeing significant factors that my sons are learning the wrong things and picking up behavior in their time with him that is very inappropriate. I dont let him drive since the DUI because im worried about my sons so I have allowed him to stay at my apartment during his visitation times because he is homeless and he goes against my home rules etc. He refuses to seek help in finding a job, i am borrowing money from friends to handle things without his support, and he wont agree to my rules of raising our sons. I want to keep him from coming to the house anymore and have sole custody. can i keep him from taking my sons in the meantime? is sole custody possible?

You can file a motion for sole custody but it will only be granted if your ex-husband agrees or the judge thinks it is in the best interests of your children. If you need help, you can email me at [email protected].
