Change in custody
I am seeking custody of our 9 year old son. He asked me to take his mother to court so he could live with me. I asked why and he said because you do things with me and help me with my homework.
He is currently failing in school and having major problems with his teachers. I had a meeting with his teacher and counselor. They both agree he should live with me. TRhey could not put it in writing that he should but, wrtote down some of the problems he has. One of them said he does really good on the friddays when he is to see and is very happy on the mondays he is returned. What Forms do I need to file. what are my chances. Should I bring the letters to the judge and let him read them ?

You need an order to show cause and an application for order and supporting declaration. Also, you will need to check the local rules concerning additional forms. If your court has a Family Court Facilitator, they may be able to help you prepare the forms. Since this is a change of custody, you will improve your chances greatly if you retain an attorney. A nine year old does not get his say in where he lives, but may have some input. The letters are not admissable without being under penalty of perjury. Good Luck, Pat McCrary
