Changing a childs last name legally due to marriage of biological mother

I have recently married and would like to have my son's last name changed to my married name, it is currently legally my maiden name. His biological father signed away his rights and I have sole custody of him. Does my husband have to legally adopt my son before we can change his last name? If yes, is there a way we can simplify the process since there will be no contesting party? Would I be able to change his last name through the Social Security Administration without my husband legally adopting him? We would like to go through the adoption process but can't afford the legal fees. It would mean a lot to all of us if we could all share the same last name and really be a family like we planned.

Go to your local probate court. I think you can do it without adoption, but they'll be able to help you.
