changing childs name

About 3 years ago I changed my sons last name from his fathers to mine. We were never married. He did not show up to contest. I would like to change it again to my new last name (my husbands). Would his father (who has not been in his life for five years) have to be notified again?

The simple answer is yes, unless the father's parental rights have been terminated.
