child custody with domestic abuse

My husband and I live in Ct and his children now ages 15 and 10 live in Az with their mother. He discovered, during some counseling with his boys, that their step father had hit the oldest one and left bruises on his face and legs. We have received a copy of the police report, but CPS in Az does not feel that there is a threat to his children. He tried to prosecute this man through the CA, but they said it was too old, he was 11 at the time, and corporal punishment is allowed in Az. My husband now has an attorney and is going for Sole custody, which the mother has at this point, which we still don't understand how that happened. Anyway what do you think his chances are of getting the kids out of the mother's house and away from step father and into a safe environment, our house?

Fighting for sole custody in many circumstances, is extremely difficult unless the facts are truly "bad." Unfortunately, I do not have enough facts from your question to give you an answer. It would take much more than a question posted on this website to answer that question.
