child custody

im in the process of getting a divorce and have 2 children. currently the father has physical custody per court agreement and ive decided i want custody of our children. im debating wether to file for modification before my divorce is finalized or let my divorce be finalized after going to court for 1 yr and then file for modification. What option is better? and if i file after my divorce is finalized, will it make it more difficult for me to obtain custody?

While the court must always consider the best interests of the children as its standard, there are different required elements for a motion for modification and an intial custody determination. The current agreement is only temporary, I assume, if you haven't gotten a judgment at this point. Therefore, it would be smarter to obtain custody now, that is before the divorce is finalized, then to do so after judgment. If you need further help, you can email me at [email protected].
