Child Support Second Job Part II

Thank you for answering my initial question. I have a further question. At my primary job I am exempt status- my pay stub states I work 35 hours a week. In truth, I work far more than this per week which my employer can verify. How if at all does this affect the 45 hour rule- can my second income still be touched since I technically only work 35 hours?

It really depends on if you are a salaried employee or an hourly employee. If you can consider your pay salary then there shouldn't be an issue. Many if not most salaried people work more than 35 hours a week, but their pay stubs state 35 hours a week for other reasons.

The regulations indicate that inclusions in gross income include "hourly wages for regular, overtime and additonal employment not to exceed 45 total paid hours per week."

You should be aware that a court could consider more than 45 hours a week up to 52 hours a week as a deviation from the child support guidelines in certain circumstances.
