Child Support modification

My ex-husband and I were divorced in NYS but since then both moved to CT. Can someone please let me know what state laws apply now that we're both CT residents. Should I look for an NY or a CT attorney?

First of all, which state laws apply and where the modification should be filed are two very different questions.

Since you both now live in CT, you need to register the NY judgment in CT and then file your motion to modify in the CT case. CT will recognize the NY judgment as a CT judgment. A court in CT will then have the authority to modify it.

Whether NY laws apply as opposed to CT laws when it comes to how much child support should be paid in a modification is a very different question and one that you may need to deal with and possibly not.

You need a CT attorney as opposed to a NY attorney.
