Can child support payments be deferred if the person ordered to pay is in prison

my fiance has an order to pay child support to his ex-girlfriend because he has a child with her. currently my fiance is encarcerated. we would like to defer the payments until he is released. he has been in jail for about 3 years. his release date is at the end of this year. can you tell me what steps we can take to defer the childsupport payments so that way his credit won't be affected?

A motion to open the Judgement and modify the amount of child support should be filed, with the additional documents to set a court date and an order for hearing. After the court sets the date, the motion and all the related documents should be served by a State Marshall. A hearing will be scheduled and at that time the child support will be modified, suspended or otherwise changed to reflect the current situation. I recommend an attorney be hired to do this as it is not an easy procedure. Thanks for contacting us. Thomas F. Noonan
