child support

my son's father pays $108.00 wkly . my son's child daycare is $140.00 wkly. how do they figure wkly support?

Child support is determined pursuant to the child support guidelines. The weekly support is based upon both parent's combined NET weekly income. For instance, if both parent's net weekly income together equals $1000.00, the guidelines state that it costs $229.00 per week to raise one child on a combined net weekly income of $1000.00.

The weekly support the father pays you would be his percentage of the family income. For example, if he earns $750.00 of that $1000.00, (and you earn $250.00 of it), then he would pay you 75% of $229.00 which equals $172.00 per week.

Day care expenses are payable in addition to the weekly support. Your son's father would have to reimburse you/or pay directly, the weekly day care expense, as a percentage of his disposable income after paying you child support.

To calculate the disposable income percentage, we add the child support onto your net income, ($250 + $172= $422.00) and subtract it off his ($750.00 - $172= $578.00) and determine his percentage of total disposable family income. ($578 divided by $1000= 58%.

Using this example, he would pay 58% of the weekly day care expense, plus the weekly child support of $172.00.
