Contempt

Im going back to court for custody of my daughter. I have visitation ordered by the court.I didnt get to see my daughter this week .Her mother said no she isnt coming. What can I do?

If the custodial parent denies you the visitation that has been ordered by the court, you can try to get the court to hold the mother in contempt. As a practical matter, if the mother has any reasonable excuse, or if this is the first time this has happened, the court won't hold her in contempt, but rather will send you to Family Relations to see if you can't work something out. It's only after provable, documented, repeated denial of visitation that the court will get serious. As for changing custody, denial of visitation would have to be pretty bad before the court would use that alone as a reason to change custody or primary residence.

I might add that if the mother's conduct continues you may wish to ask the court to appoint an attorney or guardian ad litem to represent your daughter.
