custody

My daughters father is suing for joint custody of our 5 yr daughter. She has never lived with anyone but me . All because he dosent like my fiance. He is also a homosexual.

The default in the system is joint legal custody, but that doesn't mean much; what's important is who gets primary residence, which will more than likely be you. You'll need a lawyer, though. Call & I'll explain.

The ultimate decision in this case is dependant upon--not what you think of the father--but what is in the best interest of the child. The fact that the child has always resided with you is a plus. I would advise speaking with an attorney to best approach this case.
