Legal Question in Family Law in Connecticut
Custody Matters
In Connecticut, can the custodial parent move out of state with the minnor child if there is a pending judgement on a case?
My fiance's ex is planning on moving next month to Virginia when she gets married, she served him with a motion to modify, and he is obviously contesting it. If she were to move before this goes to court, would she be in violation of some sort?
Because they won't be given a hearing until sometime next month, but she plans on moving next month.

Re: Custody Matters
It depends on what the current order says, but she's probably not violating an order by moving. The danger is, the hearing might result in an order that she return the children to Connecticut. The court can't prevent her from moving, but it can give custody to the father. By the way, it is extremely unlikely that the matter will be resolved in one hearing. there's a whole series of things that are likely to happen.
