THANK YOU FOR EVERYTHING YOU DO!!

If both parents names are on the Birth certificate. There are no papers saying who has custody, if the father visits with the child and decides to keep the child, will that cause the father to be in trouble with the law? Or is it still true that because there is no custody the father has just as much right as mom and it know becomes a civil case? Thank you.

So long as there are no custody orders from a court in place which state otherwise, both parents have the right to parent the child. Law enforcement will most likely not get involved.

However, the best route to take is to get custody orders in place through the family court in your district. You should file a Custody Application and get some orders in place so you are protected.
